Terms of Service

1. Agreement
These Terms of Service govern your use of HeyOrky (“Service”) operated by HeyOrky, Inc. (“HeyOrky”, “we”). By creating an account, posting a role, or submitting payment, you agree to these Terms.
2. The Service
HeyOrky operates an autonomous AI hiring pipeline (a “mission”) consisting of resume screening, audio interviews, and ranked shortlisting. Recruiters launch missions for specific roles using mission credits purchased through HeyOrky.
3. Pricing & mission credits
- Each launched mission consumes one credit. Credits are purchased via the plans described on /settings (Monthly subscription, Sprint Pack, Scale Pack, or Extra Mission).
- Mission credits never expire, including after cancellation of a Monthly subscription.
- A launched mission runs for 90 days from activation. After 90 days the role auto-closes; re-running the same role consumes a new credit.
- The first mission per organization is free.
4. Refunds
All purchases are final. Subscription payments, mission packs, and individual mission credits are non-refundable once charged. Your first mission per organization is free with no card required, so you can evaluate HeyOrky on a real role before committing to any paid plan.
This does not limit any non-waivable rights you have under applicable consumer protection law (for example, EU/UK distance-selling regulations) or your right to dispute a charge with your card issuer or with Stripe.

5. Acceptable use
You agree not to:
- Post fraudulent, deceptive, or non-existent roles.
- Use HeyOrky to discriminate against candidates on the basis of any protected characteristic. HeyOrky's evaluation pipeline is designed to surface qualified candidates without regard to race, gender, age, religion, national origin, disability, or veteran status; you must not use the platform to circumvent that.
- Re-distribute, scrape, or aggregate candidate data outside the talent-pool consent framework.
- Reverse-engineer the AI evaluation logic to game it for purposes other than legitimate hiring.
6. AI-assisted decisions & human oversight
HeyOrky's pipeline produces a ranked shortlist; the final hiring decision rests with the recruiter (you). HeyOrky does not make hiring decisions on your behalf. Candidates have a right to request human review of any AI-assisted screening decision affecting them; you agree to honor such requests in line with applicable law (including GDPR Article 22 where applicable).
7. Data processing
When you process candidate personal data through HeyOrky, you are the “data controller” and HeyOrky is the “data processor”. The terms of that processing are set out in our Data Processing Agreement, which is incorporated into these Terms by reference. Our sub-processors are listed at /legal/sub-processors.
8. Limitation of liability

9. Termination
